Marriage

HOW TO GET MARRIED IN CANADA 
  • Get a Marriage License or
  • A Banns from a religious congregation after the public announcement of your commitment during a divine service (a church publishes this declaration, called “the publication of banns”) 
    •  Banns cannot be published (used) if you or your spouse has been married before. (You will need to get a marriage license instead)
  • Decide on a secular (civil) or sacred (religious) ceremony
  • Arrange for two witnesses
  • Get Married!

    THE USUAL PROCEDURE
    • Go in person (both or one of you depending on the province)
      & Complete the proper marriage registration form (if necessary)
      & Receive your Marriage License (to be signed by the person performing your ceremony)
    • Follow through with your wedding and have a great time
      (remember to bring your license)
    • Double-check all signatures (yours, your partners, 2 witnesses, and your officiant/minister)
    • Double-check your officiant or minister sends the proper paperwork into the government
    • Check online that your paperwork was received & that the government knows you are married
    • Optional: Order Marriage Certificate(s) from the government
    • Optional: Receive Marriage Certificate(s) in the mail (if purchased)
    • Use marriage certificate to assume name change OR
      Fill in legal name change for the government
      (to hyphenate, combine or change whole name) OR
      Continue life without changing your surname

    MARRIAGE LICENCE
    • Fees: $50 (License fees are non-refundable)
    •  Either may apply in person but must provide the following documents for each of you
      • Proof of age Gov't ID: birth certificates or passports
      • Photo ID: drivers license (or age of majority card)
      • If under 19, bring a birth certificate & written parental consent & an affidavit by parents/guardians swearing to age
    • Note: Unlike other provincial licenses, this license is only good for 30 days 
    • Each must complete an affidavit & have their signatures witnessed by the Commissioner of Oaths, a Justice of the Peace or a Notary Public
    • If previously married, divorced or widowed outside of Canada, (but not out of the province) a Newfoundland lawyer needs to provide a certified letter that you are eligible to marry in Newfoundland.

    Renewing Vows

    To renew your vows to each other, you do not need a full service, a marriage license, an legal officiant or any of the big items of a wedding, but you can if you want to! Though if you have any doubts about your original marriage's legally, try ordering a Certificate of Marriage from the government or talk with your local (Provincial) government about The Marriage Act in Canada. You could also consult an attorney with knowledge in this area.

    Renewing your vows is all about you and your partner and therefore it is a representation of you and your partner. It can have or not have, whatever you want.

    WHO CAN LEAD YOUR VOW RENEWAL CEREMONY?

     Anyone. You can choose to have a religious figure or judge lead your ceremony or you can choose a friend or family member (because they don't have to acquire a pre-authorized status or title) or you can even have no one but yourselves leading your ceremony.

    REASONS TO RENEW YOUR VOWS
    • You just want to
      • special anniversary
      • it's romantic
      • "She said so."
    • You got married legally last time but not religiously
    • You were married in a different county & want to get married again in Canada
      • does not need a marriage license, Canada recognizes your marriage
    • You got married religiously last time but not legally
      • This would require a wedding license and legal affair (whereas the others do not)
    • You have made it through a tumultuous time in your relationship and/or lives and would like to affirm the commitment and honor your perseverance
    • Something about your first wedding...
      • It was your parent(s) wedding, not yours
      • Disaster. Period.
      • No-money (or you have money now!)
      • Attendance was originally too small/too big

    Who Can Marry Us?

    You can get information you need when you apply for your marriage license or call the proper people in your province from the contacts page. Be sure to ask questions if you don't understand something.

    Obviously if you are planning a religious ceremony you will have a priest, pastor, minister, imam rabbi etc. marry you. Most religious venues have two wedding fees, one for a couple that is a part of the congregation and a higher one for those who do not regularly attend their service. Listen to their rules, some may not marry you otherwise.

    But what if you are planning a non-religious ceremony? There are many different types of officiants, different names to call them & different rules to pertaining how they qualify to marry you in each province. Make sure the person you choose to marry you is legally recognized and registered The Marriage Act in your province. Read each provincial marriage act on our Links page.

    Remember, Marriage Commissioners are not going to provide wedding planning, wedding consultation services, etc; anything which would be provided by commercial vendors. Likewise marriage commissioners and officiants etc. are not "in it for the money," but from a compassionate outlook. Often they do not earn a living wage from performing marriage ceremonies and supplement with legal work, social work or another profession.

    Beware of fake officiants who just want your money or worse, your private information.
    • Always meet before the wedding face to face (and before exchanging money)
    • Ask for any video samples of weddings they have found
    • Ask for reviews and testimonials from others they have married
    • Ask for their wedding scripts
    • Be comfortable with them, its your wedding
    • Cross-reference them with the below lists (to double check its legal)

            • Statement of Sole Responsibility Form for each divorce (signed by each of you) This form acknowledges the Ontario courts may still not recognize your previous divorce(s) and therefore your eligibility to get married
            • Document of proof from your divorce (Certificate of Divorce, Absolute Decree or original court judgement of dissolution)
            • A legal opinion from an Ontario lawyer, why the divorce/ annulment etc. should be recognized and you should be eligible to marry

      • obituary clipping from the newspaper (showing date of issue)
    • Saskatchewan: only requires the date and place of death

    BY-PROVINCE (DIVORCE)
    • Newfoundland-Labrador/ Prince Edward Island
      • If divorced outside of Canada (and the documents are in a different language) you need to include a certified letter from a practicing lawyer in the province you apply, stating your are eligible to get married
    • Ontario
      • If you were married & divorced in another country you need authorization for a marriage license from the Minister of consumer & Business Services
        • Must send the Office of the Register General: 
          • completed & signed Marriage License
          • Statement of Sole Responsibility form for each divorce (signed by each of you) This form acknowledges the Ontario courts may still not recognize your previous divorce(s) and therefore your eligibility to get married
          • Document of proof from your divorce (Certificate of Divorce, Absolute Decree or original court judgement of dissolution)
          • A legal opinion from an Ontario lawyer, why the divorce/ annulment etc. should be recognized and you should be eligible to marry
